Credit and Your Consumer Rights
The law is on your side. Since the Fair Credit Reporting Act (FCRA) in 1971, credit bureaus responsible for investigating every item disputed by consumers.
Many people believe that credit reporting companies are supported by, or part of the government. This is not true. Credit reporting companies are huge
for-profit organizations that profit from selling information about you. They have nothing to do with the federal gevernment.
As credit reporing companies grew in size in the 60's and 70's, complaints about them started to pile up. Consumers had no way of influancing what
information in their credit reports.
Fair Credit Reporting Act (FCRA)
The federal Fair Credit Reporting Act (FCRA) promotes the accuracy and privacy of information in consumer reporting companies records. In theory, the FCRA
charges the credit bureaus with resposibility for the content of their records. Consumers can challenge any of the information they deem to be inaccurate.
The consumer reporting agency and the information provider are obligated to investigate your claim. They are resposible for correcting any inaccurate, or misleading
information contained in the report.
The credit bureaus, however, resist and reject consumer disputes. They are in the credit reporting buisness to make a profit, and have developed a system to resist
any attempt to start an investigation into an issue.
Credit bureaus will request further information, clarification, and additional identification from any claim, and will reject a claim as frivolous or irrelevant.
It can become very difficult to get through the red tape to even get an investigation started at all. They will do everything in their power to discorage you from
persuing the issue further.
